Former president Donald Trump is a party in two Supreme Court cases this term that promise to have a significant effect on his presidential campaign. In its decision in March in Trump v. Anderson, the Court ruled that states do not have authority to remove Trump from the presidential ballot on the alleged ground that he “engaged in insurrection” in violation of section 3 of the 14th Amendment. In Trump v. United States, to be argued in late April, the Court will decide whether Trump enjoys presidential immunity from criminal prosecution for charged conduct that occurred while he was president. Mr. Whelan will discuss and explore these cases.
