Description

Much ink has been spilled in recent years on the propriety of "nationwide injunctions," which include orders prohibiting the government from enforcing a law against any individual, even a non-party to the litigation. The availability of such sweeping relief has led to concerns, in particular, about forum-shopping in high-profile cases on issues ranging from election law, to abortion, to gun rights. Others have questioned whether judges even have the authority to provide this relief. Less studied, however, is the related concept of the statewide injunction. Under what circumstances can or should a Wisconsin circuit court judge issue equitable remedies that apply to persons throughout the state? We are joined by a panel of expert scholars and practitioners to discuss the question, which has significant ramifications for public interest litigation against government officials and entities.
