Description

Character traits are not developed overnight.  It is thus likely that, long before a judge first displays judicial courage, he or she will first have shown courage as a law student or a young lawyer.  This is why, in the last presidential administration, those involved in judicial selection looked for lawyers who had “demonstrated” “courage” and the “ability to stay strong in the face of adversity.”  Drawing on their experiences in the executive and judicial branches of federal government, state government, in house, and private practice, our panel will discuss why, when, and how law students and young lawyers should display courage in the early stages of their careers.

The method states use to select their judges has been hotly debated for decades. Ohio is no exception, having recently started having appellate judges run on a partisan ballot. But how does the selection method of judges impact judicial independence and ultimately, judicial courage? Our panel will discuss these important issues from a variety of perspectives.

What constitutes “courage” in the legal profession? Historically, representing unpopular clients was seen as a noble obligation to ensure equal justice for all, but is that still true? Is the ABA’s Rule 8.4 desirable? When should lawyers—or law firms—not represent clients and what factors should they consider? Relatedly, when is it appropriate for clients to pressure outside counsel to limit representation of other clients for reasons other than conflicts-of-interest? How have boutique firms considered these questions? Are there sufficient opportunities for conservative pro bono work within firms? Join our panelists as they discuss how they’ve encountered these questions in their legal practice in private practice, in-house, and in government.
