Few large companies have not faced mass consumer claims. Once, these claims were primarily filed as class actions in state or federal court. In recent years, they have increasingly been filed as mass arbitrations. And often, companies find themselves defending against related consumer claims in court and arbitration at the same time.
In this webinar, in-house counsel and outside defense counsel share their thoughts about how companies can protect themselves against mass consumer claims in all forums. They will discuss the tradeoffs between class actions and mass arbitrations in light of recent procedural changes; how to select favorable judicial venues and arbitral forums; how to ensure the enforceability of companies’ preferred dispute resolution procedures; and tactics to combat abuses by the plaintiffs’ bar. The panelists will discuss not only public rules and court decisions, but also key insights that can only be gleaned from direct litigation and arbitration experience. With the consumer claim landscape in flux as we enter 2026, this webinar will help in-house counsel protect their companies from mass consumer claims in the year ahead.
