On June 13, 2013 the Supreme Court announced its decision in American Trucking Associations, Inc. v. City of Los Angeles. The question in this case was whether federal law preempts certain provisions of a “concession agreement” that trucking companies must sign before they can transport cargo at the Port of Los Angeles.
In a unanimous opinion by Justice Kagan, the Court held that the Federal Aviation Administration Authorization Act does preempt the provisions in the concession agreements between the companies. Justice Thomas filed a concurring opinion.
