Patrick J. Bumatay

Judge, United States Court of Appeals, Ninth Circuit

Biography

Patrick J. Bumatay was confirmed as a U.S. Circuit Judge for the U.S. Court of Appeals for the Ninth Circuit in December 2019. He is based in San Diego, California.

Prior to his appointment, Judge Bumatay served as an Assistant United States Attorney in the U.S. Attorney’s Office for the Southern District of California, where he was a member of the Appellate and Narcotics Sections. He also served as a Counselor to the Attorney General on criminal law issues, including on national opioid strategy and combating transnational organized crime. Judge Bumatay has also worked in the Office of the Deputy Attorney General, the Office of the Associate Attorney General, and the Office of Legal Policy at the U.S. Department of Justice. Judge Bumatay has twice received the Attorney General’s Distinguished Service Award.

Judge Bumatay previously worked as an associate at Morvillo, Abramowitz, Grand, Iason, and Bohrer in New York, New York. Judge Bumatay clerked for the Honorable Timothy M. Tymkovich of the U.S. Court of Appeals for the Tenth Circuit and the Honorable Sandra L. Townes of the U.S. District Court for the Eastern District of New York. Judge Bumatay earned his B.A., cum laude, from Yale University and his J.D. from Harvard Law School.

Josh Divine

Josh Divine

Judge, U.S. District Court, Eastern and Western Districts of Missouri

Biography

Josh Divine was most recently the Solicitor General of Missouri, where he oversaw the office's appellate and special litigation divisions. As Solicitor General, Mr. Divine led Missouri's trial and appellate teams to some of its most significant victories. Mr. Divine was lead counsel in blocking $700 billion in student loan bailouts attempted by the federal government. He was lead counsel in obtaining a $25 billion judgment against China for antitrust violations. And he was lead counsel in successfully defending the Missouri law that prohibits gender transition interventions in minors, making Missouri the only state in the nation to prevail at trial against an equal protection challenge to one of these laws. In addition, Mr. Divine's work at the trial court in Missouri v. Biden (restyled Murthy v. Missouri) helped expose systemic violations of the First Amendment by the federal government, which the trial court found was unconstitutionally pressuring social media companies to suppress millions of free speech posts.

Before serving as Solicitor General, Mr. Divine was Chief Counsel to U.S. Senator Josh Hawley, where he oversaw all legal issues, managed matters related to the Judiciary Committee, and developed tech policy. Mr. Divine clerked on the Supreme Court for Justice Thomas and on the Eleventh Circuit for Judge William Pryor. He received a J.D. from Yale Law School and a Bachelor of Science degree in mathematics from the University of Northern Colorado. His recent legal scholarship has appeared in the Virginia Law Review and the Hastings Law Journal.

Biography
Zack Austin advises Dr. Alex Karp in the Office of the CEO at Palantir. Previously, he contributed to SCOTUS briefs at Jones Day; clerked for Judge Justin Walker on the D.C. Circuit and Judge Britt Grant on the 11th Circuit; co-founded a task force backed by federal legislation to honor WW1 veterans; and supported the 2018 National Defense Strategy Commission and the 2017 National Security Strategy at AEI. He graduated from Yale University and Yale Law School, where he led the Federalist Society when it was recognized as the national Chapter of the Year. His work on federal budgetary reform won FedSoc’s writing contest for authors under 40 when he was 26. Once he sailed as a deckhand on a three-masted ship for fun.

Reginald “Reg” Brown is a partner in the Washington, D.C., office of Kirkland & Ellis LLP. He has a vibrant and diverse crisis and governmental investigations practice, and regularly counsels financial institutions and other industry-leading clients facing complex and significant regulatory, enforcement and reputational matters.

Reg provides investigations-related guidance, strategic counsel and crisis management assistance to a broad range of companies and senior executives confronting challenges and opportunities at the intersection of government, law, media and public policy. He has assisted leading institutions and high-profile individual clients with more than a hundred congressional inquiries, as well as numerous federal, state and global government investigations and crisis avoidance and mitigation matters.

Reg leads teams of lawyers responding to some of the most challenging Department of Justice (DOJ), Consumer Financial Protection Bureau (CFPB), State Attorneys General and other regulatory or enforcement matters for financial institutions. Many of his clients are among the world's most prominent banks, hedge funds, private equity and venture firms, energy companies, government contractors, healthcare institutions and technology firms, as well as CEOs and high-ranking public officials. Reg has also assisted prospective and incumbent high-level public officials in connection with complex ethics agreements and governmental controversies.

Prior to joining Kirkland, Reg was a partner at WilmerHale, where he served as chairman of the firm's Financial Institutions Group and led the firm's congressional investigations practice as vice chair of the Crisis Management and Strategic Response Group. Among other things, Reg served as a counselor for the White House Office of Political Affairs, Presidential Personnel Office and the National Economic Council.

Prior to his government service, Reg served as assistant to the CEO and vice president of corporate strategy at Nationwide Mutual Insurance Company, and as the deputy general counsel to former Florida Governor Jeb Bush. He served as a Peace Corps volunteer in the Federated States of Micronesia early in his professional career.

D. John Sauer

D. John Sauer

Solicitor General, United States of America

Biography

On April 4, 2025, D. John Sauer became the 49th Solicitor General of the United States. He previously served as Solicitor General of Missouri from 2017 to 2023.. Before that, he served as a federal prosecutor for five years and spent time in civil practice at boutique law firms, including the firm he founded, the James Otis Law Group.  Mr. Sauer has first-chaired many jury and bench trials, and served as lead counsel in many appeals.  He has presented oral argument in the U.S. Supreme Court, the U.S. Court of Appeals for the Eighth Circuit, the Supreme Court of Missouri, and many other state and federal appellate courts.  Mr. Sauer served as a law clerk to Justice Antonin Scalia of the U.S. Supreme Court and Judge J. Michael Luttig of the U.S. Court of Appeals for the Fourth Circuit.  He was a Rhodes Scholar and a magna cum laude graduate of Harvard Law School.

Brett A. Shumate was sworn in as the Civil Division’s 36th Assistant Attorney General on June 11, 2025.  He previously served in the Civil Division from 2017 to 2019 as the Deputy Assistant Attorney General for the Federal Programs Branch.  Prior to rejoining the Department, Mr. Shumate was a partner at Jones Day in Washington, D.C. 

Mr. Shumate clerked for Judge Edith H. Jones on the United States Court of Appeals for the Fifth Circuit.  He graduated from Wake Forest University School of Law and Furman University.
