Biography

Andrew Mergen is a Visiting Assistant Clinical Professor of Law and Faculty Director of the Emmett Environmental Law & Policy Clinic. Prior to joining the Harvard Law School faculty, Andrew Mergen served in the Appellate Section of the Environment & Natural Resources Division (ENRD) at the United States Department of Justice. Professor Mergen began his career at the Justice Department in the Honors Program and concluded his career as Chief of ENRD’s Appellate Section. He has presented oral arguments in all 13 federal courts of appeals, including two en banc courts, and before several state intermediate and supreme courts. He has also worked on over a dozen merits cases in the Supreme Court of the United States. In addition, in 2009, Professor Mergen assisted the Office of White House Counsel on the confirmation of the Honorable Sonia Sotomayor as Associate Justice of the Supreme Court. During his career at the Justice Department, Professor Mergen received the Attorney General’s Award for Distinguished Service three times. He also received ENRD’s Muskee-Chafee Award, honoring his work’s significant contribution to protecting the environment.

Before entering clinical teaching, Professor Mergen taught at several law schools including, Harvard Law School (Advanced Environmental Law), the University of Michigan Law School (Natural Resources Law) and the William S. Richardson School of Law, University of Hawaii-Manoa (Administrative Law). Professor Mergen has written about federal water rights in “A Misplaced Sensitivity: The Draft Opinions in Wyoming v. United States” (68 Colo. L. Rev. 683 (1997), with Sylvia F. Liu); energy development on public lands in “Surface Tension: The Problem of Federal Private Split Estates” (33 Land & Water L. Rev. 419 (1998)); climate change and the Endangered Species Act in “The Role of Climate Change in ESA Listing Decisions” (53 Rocky Mt. Min. L. Fdn. 67 (2016), with Murray Feldman) and the accommodation of Native American sacred sites on federal land in “Finding the Path Forward for Indigenous Sacred and Cultural Spaces on Federal Public Land,” 68 Nat. Drawing from two decades of experience in senior government, in-house corporate, and private law firm roles, Jeff Wood helps clients with federal enforcement, compliance, litigation, permitting, and policy challenges primarily in the energy and environmental fields.

Prior to joining Baker Botts, Mr. Wood served for almost two years as the Acting Assistant Attorney General (AAG) for the Justice Department's Environment and Natural Resources Division (ENRD). In that capacity, Mr. Wood led ENRD and its more than 600 attorneys and staff representing EPA, Departments of the Interior, Energy, and Defense, and other agencies in civil and criminal enforcement and defensive environmental, energy, and natural resources litigation.

James S. Burling

Biography

Before becoming an attorney, James had been a productive member of society working as an exploration geologist in the late 1970s throughout the southwestern United States. However, after several years of dealing with irrational government bureaucrats and environmental policies untethered from reality, James decided that what the world needs is more lawyers — if they are willing to fight for rationality in regulatory regimes, property rights, and liberty.

James attended the University of Arizona College of Law in Tucson, where he served as an editor for the Law Review and received a J.D. degree in 1983. He had previously received a Masters degree in geological sciences from Brown University and an undergraduate degree from Hamilton College in New York. James received the Professional Achievement Award from the University of Arizona Alumni Association in 2018.

James has worked with Pacific Legal Foundation since 1983, litigating cases from Alaska to Florida. He is a member of the Federalist Society’s Environmental Law and Property Rights Practice Group’s Executive Committee, a member of the American College of Real Estate Lawyers, and an honorary member of Owners Counsel of America, an organization comprised of eminent domain attorneys who represent property owners. The Owners Counsel awarded James its Crystal Eagle award in 2013. In 2022, James was awarded the Brigham-Kanner Property Rights Prize at the William & Mary College of Law. The prize is awarded annually to an individual whose work has advanced the cause of property rights and has contributed to the overall awareness of the important role property rights occupy in the broader scheme of individual liberty.

In 2001, James successfully argued a major property rights case, Palazzolo v. Rhode Island, before the United States Supreme Court, a case which affirmed that rights in regulated property do not disappear when land is bought and sold. He has written extensively on all aspects of property rights and environmental law and frequently speaks on these subjects throughout the nation.

When James is not suing the government he enjoys skiing faster than he should, bicycling, hiking, swimming, and spending quality time with his wife, family, and grandchild.

Sam Kalen

Associate Dean and William T. Schwartz Distinguished Professor of Law, University of Wyoming College of Law

Biography

Sam Kalen joined the University of Wyoming College of Law faculty in 2009, and he is the William T. Schwartz Distinguished Professor of Law and Associate Dean, as well as the founder and co-director of the School’s Center for Law and Energy Resources in the Rockies. Sam earned his B.A. from Clark University in Worcester, Mass., his J.D. from Washington University School of Law in St. Louis, and he spent a year studying legal history and constitutional thought in a PhD program at the University of Virginia. Before joining UW, Sam taught as a visitor or adjunct at a number of other law schools, he also served in the Solicitor’s Office at the Department of the Interior during the Clinton administration, and he practiced for many years with a Washington, D.C., law firm. Immediately after law school, he clerked at the Missouri Supreme Court.

Sam is passionate about teaching and writing in a variety of areas that impact environmental, public lands and natural resources, energy, and administrative law. He spent years practicing in each of these areas, including working with Indigenous Peoples and Tribal Nations, and attempts to explore these areas in both the classroom and in his scholarship. He is the author and co-author of numerous law review articles, including one that was cited and quoted in a Supreme Court opinion. His most recent law review article appeared in Maryland Law Review, on "Public Land Management’s Future Place: Envisioning a Paradigm Shift" (Vol 82, page 240, 2023). He also is a co-author of the American Bar Association’s Endangered Species Basic Practice Series book (2nd edition), a co-author of Natural Resources Law and Policy (3rd ed. Foundation Press), and a co-author Energy Follies: Missteps, Fiascos, and Successes of America’s Energy Policy (Cambridge U. Press 2018).

Sam alternates teaching a variety of courses, including Environmental Law, Administrative Law, Legislation, Legal History, Public Lands & Natural Resources, Energy Law, Energy & Climate Law & Policy, and Indian Law. He also has taught field courses, including courses exploring energy and natural resource issues in Wyoming, as well as a course on Public Lands and Natural Resources in Grand Teton National Park. Professor Kalen also has worked collaboratively with the University’s Haub School of Environment and Natural Resources.

Jonathan Wood

Biography

Jonathan Wood is vice president of law and policy at the Property and Environment Research Center (PERC). An attorney, Jonathan has litigated environmental and property-rights cases in the Supreme Court of the United States, federal and state appellate courts, and trial courts across the country. His writing has appeared in the Wall Street Journal, Washington Post, National Review, Reason, and other outlets. And his research has been published in journals such as Environmental Law Reporter, Yale Journal on Regulation Notice & Comment, Pace Environmental Law Review, and California Western Law Review.

Prior to coming to PERC, Jonathan was a senior attorney at Pacific Legal Foundation, where he litigated cases concerning the Endangered Species Act, Clean Water Act, and other federal environmental laws. He was co-counsel for forest landowners in Weyerhaeuser Co. v. U.S. Fish and Wildlife Service, in which the Supreme Court ruled unanimously that private land could not be arbitrarily regulated as critical habitat under the ESA. He also led a successful effort to reform regulation of threatened species to better align the incentives of private landowners with the interests of rare species.

Jonathan has testified before several congressional committees on wildlife conservation and endangered species topics. He has also appeared on national television and radio, including NPR’s All Things Considered, C-Span’s Washington Journal, Stossel, Fox News, and Hill.TV.

Jonathan has a law degree from the New York University School of Law, a masters degree in economic policy from the London School of Economics, and a bachelor’s degree in economics from the University of Texas. He is on the executive committee for the Federalist Society’s Environmental Law and Property Rights Practice Group and a steering committee member for the Environmental Law Institute’s Emerging Leaders Initiative.

David Uhlmann

Assistant Administrator (Nominee), United States Environmental Protection Agency

Biography

Professor David M. Uhlmann has been nominated by President Biden to serve as assistant administrator for enforcement and compliance assurance at the U.S. Environmental Protection agency. If confirmed by the United States Senate, Professor Uhlmann will take a leave of absence from Michigan Law so that he can lead federal criminal, civil, and administrative enforcement of the environmental laws, including the Clean Air Act, the Clean Water Act, hazardous waste laws, the Safe Drinking Water Act, and the Toxic Substances Control Act.

Professor Uhlmann is an internationally recognized expert on environmental law, leading authority on criminal enforcement of the environmental laws in the United States, and highly-regarded advocate for environmental stewardship and corporate sustainability programs. At Michigan Law he is the Jeffrey F. Liss Professor from Practice and the director of the Environmental Law and Policy Program. Professor Uhlmann previously served for 17 years as a federal prosecutor, including seven years as chief of the Environmental Crimes Section at the U.S. Department of Justice. In that role, he led prosecution of environmental and wildlife crimes nationwide, coordinated national legislative, policy, and training initiatives regarding criminal enforcement, and chaired the Justice Department’s Environmental Crimes Policy Committee. He earned a reputation for prosecuting polluters aggressively and fairly, presided over expansion of the environmental crimes program, and strengthened relationships with the Environmental Protection Agency, the Coast Guard, and other law enforcement partners. His work as lead prosecutor in United States v. Elias is chronicled in The Cyanide Canary. He received numerous Justice Department and EPA awards for his precedent-setting prosecutions, including the first environmental justice criminal trial.

Professor Uhlmann served from 2017 to 2020 as the Counselor to the Michigan Law alumnus Larry D. Thompson, the Compliance Monitor and Independent Auditor appointed by the Justice Department and EPA in the wake of the Volkswagen diesel scandal. In addition to advising the monitor, Professor Uhlmann made numerous presentations to the Volkswagen and Audi boards regarding environmental law in the United States, corporate accountability, and promoting environmental stewardship and an ethical culture. Professor Uhlmann has testified before Congress about the use of environmental protections to address shortcomings in worker safety laws and redressing environmental harm in corporate settlements; he has lectured widely about corporate crime and the exercise of prosecutorial discretion in cases involving corporate wrongdoing. Dan Sullivan

United States Senate, Alaska

Biography

Dan Sullivan was sworn in as Alaska’s eighth United States Senator on January 6, 2015. Sullivan serves on four Senate committees vital to Alaska: the Commerce, Science and Transportation Committee; the Armed Services Committee; the Environment and Public Works Committee; and the Veterans' Affairs Committee.

Prior to his election to the U.S. Senate, Sullivan served as Alaska’s Attorney General and Commissioner of the Alaska Department of Natural Resources. As Alaska's Attorney General, Sullivan’s number one priority was protecting Alaskans, their physical safety, financial well-being, and individual rights – particularly Alaska’s most vulnerable. During his tenure he spearheaded a comprehensive statewide strategy – the “Choose Respect” campaign – to combat Alaska’s high rates of domestic violence and sexual assault. Under Sullivan’s leadership, the Department of Law also undertook an aggressive strategy of initiating and intervening in litigation aimed at halting federal government overreach into the lives of Alaskans and their economy.

As Commissioner of the Alaska Department of Natural Resources, Sullivan managed one of the largest portfolios of oil, gas, minerals, renewable energy, timber, land, and water in the world. Working closely with Alaska’s Governor and state legislature, Sullivan developed numerous strategies that spurred responsible resource development, energy security, and a dramatic increase in good-paying jobs across a number of critical sectors in the Alaska economy. He also developed a comprehensive plan to streamline and reform the state’s regulatory and permitting system.

Sullivan is one of a select number of Alaskan attorneys who has held judicial clerkships on both the highest federal and state courts in Alaska. He served as a judicial law clerk for Judge Andrew Kleinfeld of the United States Court of Appeals for the Ninth Circuit in Fairbanks, Alaska and for Chief Justice Warren Matthews of the Alaska Supreme Court in Anchorage, Alaska. Sullivan also served as a judicial law clerk/intern for Judge James L. Buckley on the United States Court of Appeals for the District of Columbia Circuit.

Sullivan has a distinguished record of military and national security service. He is currently an infantry officer and Lieutenant Colonel in the U.S. Marine Corps Reserves. Over the past 21 years, Sullivan has served in a variety of command and staff billets on active duty and in the reserves, including: TRAP Force Commander and 81mm mortar Platoon Commander, 31st Marine Expeditionary Unit (Special Operations Capable); Weapons Company Executive Officer, Second Battalion, Fifth Marines; Commanding Officer, Delta Company, Anti-Terrorism Battalion; Executive Officer, Echo Company, Fourth Reconnaissance Battalion; and Commanding Officer, 6thAir Naval Gunfire Liaison Company (ANGLICO). In 2004, Sullivan was recalled to active duty for a year and a half to serve as a staff officer to the Commander of U.S. Central Command, General John Abizaid, spending substantial time deployed in the Middle East, the Horn of Africa, and Central Asia. In July 2013, Sullivan was recalled to active duty to serve with a Joint Task Force in Afghanistan focusing on dismantling terrorist networks and criminalizing the Taliban insurgency.

Sullivan served in the Administration of President George W. Bush as the U.S. Assistant Secretary of State for Economic, Energy, and Business under Secretary of State Condoleezza Rice. He focused on fighting terrorist financing, and implementing policies relating to international energy, economic, trade, finance, transportation, telecommunications, and Arctic issues. Sullivan also served as a Director in the International Economics Directorate of the National Security Council staff at the White House.

Sullivan earned a B.A. in Economics from Harvard University in 1987 and a joint law and Masters of Science in Foreign Service from Georgetown University in 1993. Dan and his wife Julie Fate Sullivan were married over 20 years ago in Julie’s hometown of Fairbanks, Alaska. They have three teenage daughters: Meghan, Isabella and Laurel.

Sara Gosman

Biography

Professor Gosman is an associate professor at the University of Arkansas School of Law who teaches and writes in the areas of environmental and energy law. Her courses include environmental law, energy law and policy, and natural resources law as well as Torts. Her research explores the ways in which uncertainty about risk creates both challenges and opportunities for policy; in her current work, she focuses on the governance of risks from the development and transportation of oil and natural gas. Professor Gosman is an expert on the laws governing the risks of energy pipelines. She has written on rationalism in pipeline safety policy and the treatment of risk in pipeline siting. Since 2016, she has represented the public on the Gas Pipeline Advisory Committee, a federal advisory committee to the Pipeline and Hazardous Materials Safety Administration of the U.S. Department of Transportation. She is also the President of the Board of Directors for the Pipeline Safety Trust, a non-profit organization devoted to pipeline safety. From 2017-2018, she was a member of a National Academies of Science, Engineering, and Medicine committee on the safety of propane gas facilities. Prior to joining the University of Arkansas School of Law in 2014, Professor Gosman was a lecturer at the University of Michigan Law School. She taught courses in toxics, Supreme Court environmental litigation, environmental justice, and oil and gas law. She has also practiced as a water resources attorney at the National Wildlife Federation and as an assistant attorney general in the environmental division of the Michigan Department of Attorney General. Professor Gosman received an A.B. with high honors from Princeton University and a J.D., cum laude, from Harvard Law School, where she was senior editor of the Harvard Environmental Law Review. Aaron M. Streett

Aaron Streett is the Chairman of Baker Botts’ Supreme Court and Constitutional Law Practice. He has presented oral argument in scores of appeals, covering the U.S. Supreme Court and courts around the country—including over 40 arguments between the Fifth and D.C. Circuits alone. Mr. Streett’s practice involves virtually all substantive areas of the law, including commercial litigation, statutory interpretation, constitutional law, administrative law, securities, and jurisdictional issues. James S. Burling

Biography

Before becoming an attorney, James had been a productive member of society working as an exploration geologist in the late 1970s throughout the southwestern United States. However, after several years of dealing with irrational government bureaucrats and environmental policies untethered from reality, James decided that what the world needs is more lawyers — if they are willing to fight for rationality in regulatory regimes, property rights, and liberty.

James attended the University of Arizona College of Law in Tucson, where he served as an editor for the Law Review and received a J.D. degree in 1983. He had previously received a Masters degree in geological sciences from Brown University and an undergraduate degree from Hamilton College in New York. James received the Professional Achievement Award from the University of Arizona Alumni Association in 2018.

James has worked with Pacific Legal Foundation since 1983, litigating cases from Alaska to Florida. He is a member of the Federalist Society’s Environmental Law and Property Rights Practice Group’s Executive Committee, a member of the American College of Real Estate Lawyers, and an honorary member of Owners Counsel of America, an organization comprised of eminent domain attorneys who represent property owners. The Owners Counsel awarded James its Crystal Eagle award in 2013. In 2022, James was awarded the Brigham-Kanner Property Rights Prize at the William & Mary College of Law. The prize is awarded annually to an individual whose work has advanced the cause of property rights and has contributed to the overall awareness of the important role property rights occupy in the broader scheme of individual liberty.

In 2001, James successfully argued a major property rights case, Palazzolo v. Rhode Island, before the United States Supreme Court, a case which affirmed that rights in regulated property do not disappear when land is bought and sold. He has written extensively on all aspects of property rights and environmental law and frequently speaks on these subjects throughout the nation.

When James is not suing the government he enjoys skiing faster than he should, bicycling, hiking, swimming, and spending quality time with his wife, family, and grandchild.

Sam Kalen

Biography

Sam Kalen joined the University of Wyoming College of Law faculty in 2009, and he is the William T. Schwartz Distinguished Professor of Law and Associate Dean, as well as the founder and co-director of the School’s Center for Law and Energy Resources in the Rockies. Sam earned his B.A. from Clark University in Worcester, Mass., his J.D. from Washington University School of Law in St. Louis, and he spent a year studying legal history and constitutional thought in a PhD program at the University of Virginia. Before joining UW, Sam taught as a visitor or adjunct at a number of other law schools, he also served in the Solicitor’s Office at the Department of the Interior during the Clinton administration, and he practiced for many years with a Washington, D.C., law firm. Immediately after law school, he clerked at the Missouri Supreme Court.

Sam is passionate about teaching and writing in a variety of areas that impact environmental, public lands and natural resources, energy, and administrative law. He spent years practicing in each of these areas, including working with Indigenous Peoples and Tribal Nations, and attempts to explore these areas in both the classroom and in his scholarship. He is the author and co-author of numerous law review articles, including one that was cited and quoted in a Supreme Court opinion. Jonathan Wood

Biography

Jonathan Wood is vice president of law and policy at the Property and Environment Research Center (PERC). An attorney, Jonathan has litigated environmental and property-rights cases in the Supreme Court of the United States, federal and state appellate courts, and trial courts across the country. His writing has appeared in the Wall Street Journal, Washington Post, National Review, Reason, and other outlets. And his research has been published in journals such as Environmental Law Reporter, Yale Journal on Regulation Notice & Comment, Pace Environmental Law Review, and California Western Law Review.

Prior to coming to PERC, Jonathan was a senior attorney at Pacific Legal Foundation, where he litigated cases concerning the Endangered Species Act, Clean Water Act, and other federal environmental laws. He was co-counsel for forest landowners in Weyerhaeuser Co. v. U.S. Fish and Wildlife Service, in which the Supreme Court ruled unanimously that private land could not be arbitrarily regulated as critical habitat under the ESA. He also led a successful effort to reform regulation of threatened species to better align the incentives of private landowners with the interests of rare species.

Jonathan has testified before several congressional committees on wildlife conservation and endangered species topics. He has also appeared on national television and radio, including NPR’s All Things Considered, C-Span’s Washington Journal, Stossel, Fox News, and Hill.TV.

Jonathan has a law degree from the New York University School of Law, a masters degree in economic policy from the London School of Economics, and a bachelor’s degree in economics from the University of Texas. James S. Burling

Biography

Before becoming an attorney, James had been a productive member of society working as an exploration geologist in the late 1970s throughout the southwestern United States. However, after several years of dealing with irrational government bureaucrats and environmental policies untethered from reality, James decided that what the world needs is more lawyers — if they are willing to fight for rationality in regulatory regimes, property rights, and liberty.

James attended the University of Arizona College of Law in Tucson, where he served as an editor for the Law Review and received a J.D. degree in 1983. He had previously received a Masters degree in geological sciences from Brown University and an undergraduate degree from Hamilton College in New York. James received the Professional Achievement Award from the University of Arizona Alumni Association in 2018.

James has worked with Pacific Legal Foundation since 1983, litigating cases from Alaska to Florida. He is a member of the Federalist Society’s Environmental Law and Property Rights Practice Group’s Executive Committee, a member of the American College of Real Estate Lawyers, and an honorary member of Owners Counsel of America, an organization comprised of eminent domain attorneys who represent property owners. The Owners Counsel awarded James its Crystal Eagle award in 2013. In 2022, James was awarded the Brigham-Kanner Property Rights Prize at the William & Mary College of Law. The prize is awarded annually to an individual whose work has advanced the cause of property rights and has contributed to the overall awareness of the important role property rights occupy in the broader scheme of individual liberty.

In 2001, James successfully argued a major property rights case, Palazzolo v. Rhode Island, before the United States Supreme Court, a case which affirmed that rights in regulated property do not disappear when land is bought and sold. He has written extensively on all aspects of property rights and environmental law and frequently speaks on these subjects throughout the nation.

When James is not suing the government he enjoys skiing faster than he should, bicycling, hiking, swimming, and spending quality time with his wife, family, and grandchild.

Sam Kalen

Associate Dean and William T. Schwartz Distinguished Professor of Law, University of Wyoming College of Law

Biography

Sam Kalen joined the University of Wyoming College of Law faculty in 2009, and he is the William T. Schwartz Distinguished Professor of Law and Associate Dean, as well as the founder and co-director of the School’s Center for Law and Energy Resources in the Rockies. Sam earned his B.A. from Clark University in Worcester, Mass., his J.D. from Washington University School of Law in St. Louis, and he spent a year studying legal history and constitutional thought in a PhD program at the University of Virginia. Before joining UW, Sam taught as a visitor or adjunct at a number of other law schools, he also served in the Solicitor’s Office at the Department of the Interior during the Clinton administration, and he practiced for many years with a Washington, D.C., law firm. Immediately after law school, he clerked at the Missouri Supreme Court.

Sam is passionate about teaching and writing in a variety of areas that impact environmental, public lands and natural resources, energy, and administrative law. He spent years practicing in each of these areas, including working with Indigenous Peoples and Tribal Nations, and attempts to explore these areas in both the classroom and in his scholarship. He is the author and co-author of numerous law review articles, including one that was cited and quoted in a Supreme Court opinion. His most recent law review article appeared in Maryland Law Review, on "Public Land Management’s Future Place: Envisioning a Paradigm Shift" (Vol 82, page 240, 2023). He also is a co-author of the American Bar Association’s Endangered Species Basic Practice Series book (2nd edition), a co-author of Natural Resources Law and Policy (3rd ed. Foundation Press), and a co-author Energy Follies: Missteps, Fiascos, and Successes of America’s Energy Policy (Cambridge U. Press 2018).

Sam alternates teaching a variety of courses, including Environmental Law, Administrative Law, Legislation, Legal History, Public Lands & Natural Resources, Energy Law, Energy & Climate Law & Policy, and Indian Law. He also has taught field courses, including courses exploring energy and natural resource issues in Wyoming, as well as a course on Public Lands and Natural Resources in Grand Teton National Park. Professor Kalen also has worked collaboratively with the University’s Haub School of Environment and Natural Resources.
