Biography

Jodi S. Balsam is Professor of Clinical Law at Brooklyn Law School and a nationally recognized expert on Sports Law. She directs the BLS Sports Law Clinic and Sports Law Externship Program. She teaches Sports Law at both BLS and NYU School of Law, and has also taught the subject at New York Law School, University of New Hampshire School of Law, Bucerius Law School in Hamburg, Germany, Mathias Corvinus Collegium in Budapest, Hungary, and the MESGO Executive Masters Program in Global Sport Governance. Professor Balsam has served as an arbitrator for the National Collegiate Athletic Association on complex infractions cases, and now serves as a neutral for FAIR Sports, which hears cases involving college athletics.

Professor Balsam frequently writes and speaks on sports law topics, including as co-author of Weiler’s Sports and the Law, a leading casebook in the field. Her publications and presentations have addressed antitrust challenges to sports leagues and organizing bodies, sports trademarks, athletes’ rights of free expression and name/image/likeness exploitation, sports gambling and integrity, sports league governance, and the role of the sports agent. Before joining academia, Professor Balsam was the National Football League's Counsel for Operations and Litigation, where she managed litigation in all areas of law, oversaw a variety of policy and operational matters, negotiated and drafted contracts for League special events including the Super Bowl, and administered the League's internal dispute resolution processes and compliance program. Prior to the NFL she was a litigator with the New York office of Simpson Thacher & Bartlett, where she represented sports and entertainment clients in antitrust matters and complex commercial litigation. She served as a law clerk for Judge Dennis Jacobs of the U.S. Court of Appeals for the Second Circuit and for Judge Charles Brieant of the U.S. District Court for the Southern District of New York. A graduate of Yale College, Professor Balsam received her law degree from NYU School of Law.

Biography

Erik Clark oversees major litigation in the Office of Ohio Attorney General Dave Yost, the State's chief law-enforcement officer. He also oversees the Office's antitrust, charitable-law, constitutional-offices, and consumer-protection sections.

As part of his role, Erik personally appears in court on behalf of the State of Ohio in select cases. He also advises the Attorney General on critical matters.

Previously, Erik was a partner for over ten years at Organ Law LLP, a Columbus litigation boutique. There, he frequently served as special counsel to the Ohio Attorney General, representing state-government clients. His cases included a challenge (by ECOT) to Ohio's school-funding system for virtual charter schools, a challenge to The Ohio State University's rules governing students' possession of firearms, a First-Amendment challenge to a law prohibiting targeted picketing at public officials' homes, and a challenge to congressional and Statehouse redistricting following the 2020 census.

Erik also represented large and small businesses and individuals in litigation, arbitration, and mediation. Among other matters, he represented Uber in cases brought by authorities seeking city-wide injunctions that would have blocked Uber from operating its then-nascent ride-sharing service in several major cities, including Columbus, St. Louis, and Tampa.

Erik has argued several appeals in federal and state appellate courts, including three cases in the Ohio Supreme Court. He has served as lead counsel in dozens of trial-court cases (including bench and jury trials), administrative hearings, and arbitrations.

Erik graduated summa cum laude from The Ohio State University Moritz College of Law, where he was Editor-in-Chief of the Ohio State Law Journal.

After law school, he clerked for Chief Judge Jeffrey S. Sutton on the U.S. Court of Appeals for the Sixth Circuit.

Erik then served as the Simon Karas Fellow in the Ohio Attorney General’s Office, where he worked with the Ohio State Solicitor on high-profile appeals before the Ohio Supreme Court, the Sixth Circuit, and the United States Supreme Court.

Rakesh Kilaru

Since joining Wilkinson Stekloff, Rakesh has played a leading, stand-up role in high-profile trial victories for Bayer and the NCAA, obtained major summary judgment victories for Bayer and Georgia-Pacific, secured full dismissal of a groundbreaking enforcement action by the Consumer Financial Protection Bureau before any discovery was taken, and successfully defended a sitting federal judge in mandamus proceedings in the D.C. Circuit.

Allen Mendenhall is a Senior Advisor for the Capital Markets Initiative and Research Fellow in the Thomas A. Roe Institute for Economic Policy Studies at the Heritage Foundation in Washington, D.C. Previously, he served as Associate Dean and Grady Rosier Professor in the Sorrell College of Business at Troy University, where he also directed the Manuel H. Johnson Center for Political Economy. Jason Torchinsky is a partner at Holtzman Vogel Josefiak PLLC, specializing in campaign finance, election law, lobbying disclosure and issue advocacy groups. Politico recently named him one of the “50 Politicos to Watch,” and in 2007, Campaigns and Elections Magazine named him a “Rising Star of Politics.”

Thomas F. Gede

Biography

Tom Gede retired in 2023 as a principal in Morgan Lewis Consulting LLC and of counsel to the firm. He currently consults on a variety of legal and policy matters for both public and private clients. Tom has a national reputation and distinguished background in federal Indian law. Prior to retirement, he represented clients in complex governmental matters in litigation, administrative and regulatory proceedings, including high-profile matters involving state governments. A former senior deputy in the California Attorney General’s office, Tom was amicus coordinator and Supreme Court counsel, and argued cases in the US Supreme Court, the California Supreme Court, and numerous state and federal appellate courts.

Tom also served as executive director of the Conference of Western Attorneys General (CWAG), coordinating activities on key legal and policy issues, such as federal Indian law, energy, environmental, public lands, financial services, and telecommunications, for the attorneys general of 18 western states and territories. In 2016, Tom was elected as a Member of the American Law Institute (ALI), and served as an Adviser on the Restatement of the Law Third - The Law of American Indians. Tom also taught federal Indian law as an adjunct law professor at the University of the Pacific - McGeorge School of Law. He served as an assistant editor for and the author of the Indian gaming chapter in CWAG’s American Indian Law Deskbook (2d & 3d eds.). He has been engaged in Indian gaming and Indian law matters for more than three decades, having focused on the gaming compacts with Indian tribes, as well as complex civil and criminal jurisdiction, land, natural resources, water and law enforcement issues in Indian country. He has testified before Congress on American Indian and Native Alaskan issues. In 2012 he was appointed by Speaker John Boehner to serve on the United States Indian Law and Order Commission, where he examined criminal justice issues in Indian country and Alaska, resulting in the issuance of an important report to the President and Congress.

Ilya Shapiro

Biography

Ilya Shapiro is a senior fellow and director of constitutional studies at the Manhattan Institute and a contributing editor of City Journal. Previously he was executive director and senior lecturer at the Georgetown Center for the Constitution, and before that a vice president of the Cato Institute.

Shapiro is the author of Lawless: The Miseducation of America’s Elites (2025) and Supreme Disorder: Judicial Nominations and the Politics of America’s Highest Court (2020), coauthor of Religious Liberties for Corporations? (2014), and editor of 11 volumes of the Cato Supreme Court Review (2008-18). Erica Smith

Biography

Erica Smith is a senior attorney with the Institute for Justice. She joined IJ in August 2011 and litigates cutting-edge constitutional cases protecting economic liberty, school choice, and free speech in federal and state courts.

Erica’s economic liberty work has a special focus on “food freedom.” Erica won Wisconsin home bakers the constitutional right to legally sell their goods in Kivirist v. Wisconsin Department of Agriculture. As a result, hundreds of home bakers across the state can now sell their cookies, cakes, and muffins without fear of fines or jail time. Erica also successfully defended the rights of home bakers and canners to fight against Minnesota’s arbitrary restrictions on selling their goods in Astramecki v. Minnesota Department of Agriculture. Erica is currently suing New Jersey—the last state to have a ban on selling homemade food. Erica’s legislative activities have also helped change the homemade food laws of several states.

Erica’s educational choice work gives parents the opportunity to guide the education of their children. She was the lead attorney representing families in Asociación de Maestros v. Departamento de Educación, where she persuaded the Puerto Rico Supreme Court to reject a teachers union’s challenge to the Commonwealth’s new voucher program. Erica was also part of the winning teams that protected both Georgia and New Hampshire’s tax-credit scholarship programs at the state supreme courts in Gaddy v. Georgia Department of Revenue and Duncan v. State of New Hampshire. She is currently fighting to protect Montana’s school choice program at the U.S. Supreme Court. Erica’s free speech work includes her successful defense of a family’s right to use signs to advertise its gym in Fears v. City of Sacramento. Most recently, Erica won the right of a family-owned video game store to advertise using a 9-foot inflatable Mario in Fisher v. Town of Orange Park.

Matthew R. Byrne

Judge, Ohio Twelfth District Court of Appeals

Biography

Judge Matthew R. Byrne was elected to the Ohio Court of Appeals for the Twelfth District in 2020, and his first term began on January 1, 2021. He is currently serving as the court's elected Administrative Judge. The Twelfth District Court of Appeals hears civil and criminal appeals from the trial courts in eight counties in southwest Ohio. Judge Byrne is active in the Ohio Judicial Conference and the Ohio Court of Appeals Judges Association. He also currently serves as a member and vice chair of the Ohio Supreme Court's Commission on the Rules of Practice and Procedure (where he previously chaired the Appellate Rules Committee). He previously served as a member of the Ohio Supreme Court's Commission on Character and Fitness.

From January 2010 to December 2020, Judge Byrne practiced law at the national law firm of Jackson Lewis P.C. He was a member of the firm's General Employment Litigation Practice Group and the Wage and Hour Practice Group. From 2007 to 2010 he practiced at Taft Stettinius & Hollister LLP. At both firms, Judge Byrne represented clients ranging from small businesses to international corporations in state and federal trial and appellate litigation, including multiple class and collective actions. He also represented clients in arbitration and before numerous administrative agencies, including the Equal Employment Opportunity Commission, the National Labor Relations Board, and the Ohio Civil Rights Commission.

Judge Byrne earned his law degree, cum laude, from The Ohio State University Moritz College of Law. During law school he was symposium editor of the Ohio State Law Journal and the winner of the Donald S. Teller Memorial Award for student writing contributing most significantly to the Ohio State Law Journal. During law school he clerked for the Acting General Counsel of the United States Department of the Treasury. Judge Byrne earned his bachelor's degree, magna cum laude, from Xavier University, where he majored in International Affairs (Business) and Political Science.

Prior to entering law school Judge Byrne served in President George W. Bush's Administration as a member of the White House staff in the Office of Presidential Personnel, the office responsible for selecting candidates to recommend to the President for appointment or nomination to high-level government positions, and for coordinating with the Offices of White House Counsel, Press Secretary, and Executive Clerk regarding candidate background clearances, press announcements, and the status of appointments/nominations.

Judge Byrne has been a member of the Federalist Society since law school and he served for five years as president of the Federalist Society's Cincinnati Lawyers Chapter. He is a member of a number of other community and civic organizations, including the Ohio State Bar Association and the bar associations of Butler, Clermont, and Warren Counties. Judge Byrne previously was a member of the Advisory Board of Pregnancy Center East and a board member and president of the St. Thomas More Lawyers Guild of Greater Cincinnati.

Judge Byrne is an active parishioner at his church, where he is a lector, a former member and president of the Education Commission, and a former member of the Finance and Administration Commission.

Braden H. Boucek

Biography

Braden H. Boucek serves as Director of Litigation at the Southeastern Legal Foundation (SLF). His cases at SLF focus on restoring constitutional balance, equal protection, the First Amendment, and property rights. He is an avid defender of America's Founding and a constitutional law professor. He has also actively litigated school choice cases.

Prior to joining SLF, he served as Vice President of Legal Affairs at the Beacon Center of Tennessee, where he worked on economic liberty, dedicated himself to Tennessee's unique constitutional rights, and protecting the free speech rights of professionals.

Braden has been a litigator since 2001. Previously, Braden was an Assistant U.S. Attorney in both Nashville and Memphis for over nine years. During that time, he handled hundreds of cases ranging from Organized Crime, Drug Trafficking, Fraud, Counterfeiting, Terrorism and Immigration offenses. Braden has been recognized by his office for performance, winning both the Special Achievement award and Distinguished Service award. Elbert Lin

Biography

The former Solicitor General of West Virginia, Mr. Lin has been on the front lines of many precedent-setting cases in appellate courts across the country, including in a US Supreme Court victory that George Will called “the court’s most severe rebuke of a president” since the Truman administration. Having argued more than 60 appeals, he brings to clients a well-honed ability to identify the most persuasive issues for appeal and a practiced understanding of how best to frame complex legal questions in appellate courts.

With experience in the private sector and multiple branches of government, Mr. Lin’s practice has spanned a wide range of issues, including major questions of constitutional and administrative law at the federal and state levels. On behalf of more than two dozen states, he won a stay from the US Supreme Court of the EPA’s Clean Power Plan. Described by the New York Times as an “unprecedented” order, the stay was the first time the Supreme Court had ever put a regulation on hold before review by a federal appeals court. In that same case, Elbert argued before the en banc DC Circuit in an historic proceeding that one commenter quoted in E&E News compared to “the NBA All-Star Game.” At the state level, Elbert led the effort that persuaded the West Virginia Supreme Court of Appeals to overturn an injunction of the state’s right-to-work law.

In 2013, Mr. Lin was appointed the Solicitor General of West Virginia. During his four-and-a-half year tenure, he served as a member of the Attorney General’s senior management team, oversaw all civil and criminal appeals, and argued nearly two dozen cases in federal and state appellate courts. He authored more than twenty-five briefs in the US Supreme Court and more than forty-five formal Opinions of the Attorney General.

John is a complex-problem solver and seasoned litigator who has successfully represented clients in a wide range of commercial litigation matters for almost 20 years. Jon Riches is the Vice President for Litigation for the Goldwater Institute’s Scharf-Norton Center for Constitutional Litigation and General Counsel for the Institute. He litigates in federal and state trial and appellate courts in the areas of economic liberty, regulatory reform, free speech, taxpayer protections, public labor issues, government transparency, and school choice, among others.

Jon has developed and authored several pieces of legislation, including the landmark Right to Earn a Living Act, which provides some of the greatest protections in the country to job-seekers and entrepreneurs facing arbitrary licensing regulations. He also developed legislation eliminating deference to administrative agencies in Arizona—a first-of-its-kind regulatory reform that can serve as a model for the rest of the country.
