Over the past 30 years, attacking the legitimacy of the Supreme Court has become all too common when the Court issues unpopular opinions. But in recent years, most notably after Dobbs, the Justices and lower-court judges alike have found themselves subject to threats, vitriol, and intimidation. How can courts continue to function in the face of increasing personal threats and a growing lack of public support? How should lawyers respond and what can be done to protect the judiciary? This panel will discuss those questions and consider what is required to maintain an independent judiciary.

Description

Texas has long recognized that parents have a fundamental right to direct the upbringing, education, and health care of their children. But in Texas and beyond, there has often been tension between that right and the responsibility entrusted to governments to educate their youngest citizens. In recent years, many alternatives to the longstanding public education model have emerged and have been bolstered due to a variety of factors including the effects of COVID shutdowns, age-inappropriate books and curriculum, and dismal academic performance. As a result, parental empowerment has taken center stage in many states through the adoption of various school choice policies. How do these factors affect the trust in America’s educational system? How have recent cases applied the line between parental rights, government power, and free expression? How will school choice policies impact Texas? Can education choice laws alone restore balance to parental rights and American education? How do these battles affect local school board races and what does that mean for representative government? Panelists will answer these questions and more as they address some of the key educational questions affecting Texas.

In recent years, whether and how to enforce immigration laws has become a (surprisingly) hot topic in the executive branch. What duty and/or privilege do states have to enforce immigration laws when the federal government chooses not to? Can states intervene in international affairs to secure their borders? And how can states enforce their rights through litigation? Discussion to include recent border and immigration policy, issues regarding (non)enforcement of immigration laws, and dispute between Texas and federal government regarding protection of federal and state sovereignty.
